Wood Tone Music, BMI

In the music industry, a music publisher (or publishing company) is responsible for ensuring the songwriters and composers receive payment when their compositions are used commercially. Through an agreement called a publishing contract, a songwriter or composer "assigns" the copyright of their work to a publishing company. In return, the company licenses songs, helps monitor where pieces are used, collects royalties and distributes them to the composers. They also secure commissions for music and promote existing compositions to recording artists, film, and television.

What is the difference between a songwriter and a publisher?

A songwriter or composer is the creator of a work, which is a song, score, or other musical composition. A publisher, on the other hand, is an individual or company that owns or administers the copyright of a work. The writer or creator of the work must assign the copyright to a publisher in order for that publisher to claim ownership.

BMI considers payments to songwriters or composers and publishers as a single unit equal to 200%. Where there is the usual division of performance royalties between songwriters or composers and publishers, the total writers' shares will be 100% (half of the available 200%), and the complete publishers' shares will be the remaining 100%.
